Oftentimes, individuals will think about attacking an audit assessment on the merits. But what if there was another way to invalidate the assessment? Florida agencies (e.g., Department of Revenue) must promulgate rules to take certain positions, most of the time. In some cases, the Department lacks the authority to promulgate a rule and base an assessment on the rule. This presentation will discuss what the Department (or most other state agencies) must do to have a valid rule and how CPAs can better protect their clients from invalid agency actions.

  • Identify when an agency uses an invalid rule 
  • Learn what options are available to clients when an invalid rule is used
  • Consider possible upside and downside ramifications to challenging agency
